一个打了近九年的房地产官司
2013年，我给北加州当医生的老同学D推荐了一套靠南加州海边的康斗，这是一个短卖(short sale)屋, 当时正在拍卖网站上竞标卖。D很喜欢这个康斗，志在必得，竞标到$65万总算拿到这房。随后 open escrow 公证交易，房屋检查及贷款一切顺利，30多天后准备过户。这个房的卖家是越南裔女性，还是房地产 Broker。就在要过户前，她提出在买价外，给她个人2万现金，否则她就取消交易。买家D认为这是无理要求，一口拒绝。卖家立即通过代理及拍卖网站通知取消了合同。D很气愤，说一定要把房子告回来。我给他推荐了一位在南加州知名的华裔房地产律师，D交了1.5万压金给华裔律师，律师向高等法院递了状子，并立即在此房产上登记Lis pendens，防止卖家将房卖别人。接着法庭开庭两次，卖家(被告)没有到庭。半年后，法庭缺席审判，判此房产交易必须继续进行，且在90天内完成，卖家(被告)须赔偿原告D租金损失两万多及律师和法庭费用两千多。
D的华裔律师拿着判决去找卖家多次，但卖家都不予理睬。卖家(被告)也上诉了此判决，但被法院驳回。D的华裔律师想了各种办法，卖家就是不签字。这样前后折腾了一年，D的华裔律师说，没办法，我们也不可能把她抓来签过户文件。D看到华裔律师无计可施，又找了一位白人律师。2016年白人律师收到2万压金后，递了个新状子，这次被告是卖家的2家贷款公司，拍卖网站及贷款公司的律师代理，状告他们毁约。随后这几家被告和原告D在法庭上展开了拉锯战，双方出庭了十次，到2019年还没搞定。其间，卖家在2017年又反告了D，这个反告其实就是拖延时间，她可以白住在那康斗，算了一下，她前后白住了8年。卖家反告递状后换了两个律师，每个律师接手后，都说要熟悉资料，开庭时间一再延期。2019年D的白人律师跟卖家谈判，说这个房子已经是拍卖屋，也不是你的了，我们给你$2万现金，你将它过户给D，卖家原告同意照办，过户后就搬出了那康斗，也将她的原告案子撤销了。早知今日，何必当初，D在2013年一开始就给她要求的2万现金，也就不会有这桩官司了。
随后白人律师全力处理告贷款公司及拍卖网站案子。上面所进行的过户不是真正有效，因为这康斗已是破产屋，拥有者贷款公司签字过户才算数。由于D和贷款公司无法达成一致，法庭安排2020年初开庭由Jury trial判决，但开庭日赶上了新冠，只得又延后。双方不能达成一致的原因是，原告D要求按原合同65万交易，但贷款公司不同意，觉得他们损失太大，康斗市值那时过了百万。最后双方各退一步，开庭前同意比65万高些的价格过户。
前不久贷款公司在deed上签字，房子总算过户了，这个官司打了近9年，真佩服老同学D的毅力，要是别人早就半途而废了，人与人就是不一样。我给D微信说，好事多磨，祝贺你总算拿到房子了。D回说，谢谢，但代价是25万元律师费！
